Gun Confiscation Sparks Conflict Between States and the Federal Government

Tensions have increased to a scorching hot level between the states and federal government as Joe Biden’s handlers move forward with gun confiscations.

Recent Senate hearings uncovered a troubling position taken by the Biden Administration’s nominee — David Chipman — to run the ATF. He’s in favor of extreme gun bans that would effectively render the majority of sporting rifles illegal. Although he tried to evade questions, Republican Sen. Tom Cotton cornered him into admitting he would categorize wide-reaching firearms as “assault weapons” and try to ban them. This was his definition of a firearm he believes the ATF can confiscate: “any semi-automatic rifle capable of accepting a detachable magazine above the caliber of .22.”

That set off a firestorm of activity at the state level, prompting Republicans to propose and enact legislation that directly conflicts with the Biden Administration’s illegal attempts to trample the Second Amendment. In Missouri, GOP Gov. Mike Parson quickly went on the record acknowledging he will sign the Second Amendment Preservation Act, which effectively nullifies federal gun control and confiscation laws.

“The Governor is aware of the legal implications of this bill, but also that, now more than ever, we must define a limited role for the federal government in order to protect citizen’s rights guaranteed by the Second Amendment of the United States Constitution,” spokeswoman Kelli Jones reportedly said.

“We are doing this bill because the Second Amendment is under attack. It’s under attack by the Democrats, specifically the Biden administration and the Democrats in Washington,” Republican state Rep. Jered Taylor reportedly said.

That sentiment has gained traction around the nation as conservative leaders see a Civil War-level divide growing between states and the Democrat majority holding sway over the federal government. The Louisiana legislation recently passed a constitutional carry bill that eliminates a requirement that a citizen needs to ask the government to carry a lawfully obtained firearm.

With Joe Biden’s liberal handlers calling the shots at the ATF, officials have attempted an end-run to make pistol stabilizing devices illegal. These mechanisms are largely used to help disabled people use a firearm. Many disabled veterans rely on stabilizers for effective home defense and sport shooting activities. At the U.S. Department of Justice, notoriously liberal Attorney General Merrick Garland leads a gun confiscation charge. In an effort to federalize so-called “red flag” gun confiscation regulations, the DOJ now backs the lowest legal threshold to date.

A “court shall issue an emergency ex parte extreme risk protection order upon submission of an application by a petitioner, supported by an affidavit or sworn oral statement of the petitioner or other witness, that provides specific facts establishing probable cause that the respondent’s possession or receipt of a firearm will pose a (significant danger/extreme risk/other appropriate standard established by state law) of personal injury or death to the respondent or another person,” the Biden order reportedly states. “The respondent shall have the burden of proving, by the same standard of proof required for issuance of such an order, that he or she does not pose a (significant danger/extreme risk/other appropriate standard specified by state law) of personal injury or death to himself or herself or another.”

In non-legal jargon, this means anyone can make a false statement and force a judge to send law enforcement to take away their guns. After the door is broken down and the feds leave with someone’s firearms, they will have to prove the allegations false, or the feds keep the guns.

The Washington, D.C., Democrats’ attacks on the U.S. Constitution have gone far beyond the pale. Rather than unite Americans as promised, the Biden Administration has divided the country in ways not experienced since the Civil War. It appears another conflict is brewing that could splinter the union.
